Right to Manage was a power given to leaseholders in 2002 by the Commonhold and Leasehold Reform Act. The legislation empowered homeowners to force the transfer of the landlord's management functions to a special company set up by them - the right to manage company. The right was introduced not only to wrestle power away from poor landlords but to give the decision of managing the block to the people it affected most, the leaseholders.
Right to Manage is a technical legal process requiring diligence, accuracy and experience. Base Estate Management have now advised on a number of successful Right to Manage actions resulting in the removal of failing management companies. A common failing encountered on numerous occasions is the inability of management companies to budget in advance with any real accuracy. In nearly all cases the result is an overspend of the service charge collected, and an immediate recharge to disgruntled leaseholders. At Base Estate Management, we pride ourselves in accurate, methodical and sensible budgeting.
Another key to successful budgeting is efficiency when purchasing services. As many management companies spread their power across the country, their efficiencies of purchase dilute. We have seen examples of contractors travelling over two hours to change light bulbs and charging outrageous fees for their troubles. Base Estate Management concentrate solely on the North West meaning our service and concentration levels remain unaffected.
Failing management companies are also often found to be weak in the collection of service charge. We have encountered several developments where the absence of funds collected has resulted in the management company withdrawing essential services such as cleaning, gardening and waste removal. At Base Estate Management, we are proud to say we will never look to take this path. We believe it is down to our team to collect service charge funds effectively and not to penalise paying leaseholders for the reluctance of a small minority.
In summary, Right to Manage legislation has been put in place to help homeowners with nowhere to turn. Poor management companies can now be held accountable and removed for their ineffective performance.
